Proposed Regulations

Draft Enforcement, Project Applications, and Notice Requirements for State and Local Government Projects


The Commission is updating the Critical Area regulations located in the Code of Maryland Regulations (COMAR), Title 27. The purpose of this proposal includes:

  • Adding to COMAR the enforcement requirements found in the Natural Resources Article §§8-1808, 8-1815, and 8-1815.1​, Annotated Code of Maryland.
  • Increasing the public notice timeline for State and local government projects from 15 days to 30 days in COMAR 27.03.01.03.
  • Updating the type and number of project applications a local government submits to Commission staff for their review and comment in COMAR 27.03.01.04.

The regulations are currently under review by the Administrative, Executive, and Legislative Review Committee and are tentatively scheduled to appear in the August 22, 2025 edition of the Maryland Register. When publication occurs, a link will be provided.
