Memorandums of Understandings with State Agencies

COMAR 27.02.03 provides for a General Approval process that the Commission can use to develop Memorandum of Understandings (MOU) with other State Agencies. The MOU can be used when development activities are of a minor scale in the Critical Area.
MOUs address the process used by the Commission and the State agency for approval; the responsibilities of both parties; and the process to be used by both parties to establish mitigation banks. Each MOU has its own details regarding the specific projects that can be reviewed, the thresholds for disturbance/impacts for projects that could qualify under the MOU, and the necessary mitigation.
