IN THE ZONE is a service from your Chesapeake & Coastal Program team that delivers timely information, tools and resources to those living and working in Maryland’s coastal zone.


Chesapeake and Atlantic Coastal Bays 2010 Trust Fund

Under Governor O’Malley’s leadership, the Chesapeake and Atlantic Coastal Bays 2010 Trust Fund was created during the 2007 special session of the General Assembly to help restore the health of the Chesapeake Bay.  A competitive process has recently been announced (view press release) through which local governments, community groups, non-profit organizations, academic institutions and private enterprises may apply for local implementation grants from the Fund.

 

The State of Maryland is seeking proposals for targeted, multi-partner, and multi-practice non-point source pollution reduction projects during State fiscal years 2009 and 2010.  Proposals are due by August 29, 2008.

2008 Legislative Round-Up

Highlighted below are some of the bills that passed during the 2008 Session which have relevance to the Chesapeake & Coastal Program, our partners and coastal stakeholders.  Click on the links below to be directed to a summary of each bill:

 

SB213/HB369 – Chesapeake and Atlantic Coastal Bays 2010 Trust Fund and Nonpoint Source Fund.

These Administration bills provide a framework for how the trust fund money must be spent by specifying that it be used for nonpoint source pollution control projects and by expanding it to apply to the Atlantic Coastal Bays.  The bills generally codify the BayStat Program to measure and evaluate bay restoration efforts, expand its charge to include the Atlantic Coastal Bays, and expand its duties to include the administration of the trust fund.  The bills take effect July 1, 2008.

 

HB1253 – Chesapeake and Atlantic Coastal Bays Critical Area Protection Program – Administrative and Enforcement Provisions.

This Administration bill provides greater authority to the Critical Area Commission for the Chesapeake and Atlantic Coastal Bays by updating the basic components of the program, enhancing buffer and water quality protection, coordinating new development more closely with growth management policies and other environmental protection and planning processes, and strengthening enforcement and variance provisions.  The bill takes effect July 1, 2008.

 

HB973 – Water Management Administration – Living Shoreline Protection Act of 2008. 

This bill amends Title 16 of the Environment Article, Annotated Code of Maryland, entitled Wetlands and Riparian Rights (Wetlands Act of 1970) to require that improvements to protect a person’s property against erosion shall consist of nonstructural shoreline stabilizations measures (i.e., living shorelines) except where the person can demonstrate to MDE that such measures are not feasible, or where MDE mapping indicate areas appropriate for structural shoreline stabilization measures. The Act also requires MDE, in consultation with DNR, to adopt regulations to implement specific provisions, including adopting a waiver process for those instances where nonstructural shoreline stabilization measures have been demonstrated to be unfeasible.  This bill takes effect October 1, 2008.

Chesapeake & Coastal Program Enters its 30th Year (1978-2008)

This year marks the 30th anniversary of Maryland’s Coastal Zone Management Program.  Maryland’s coastal zone includes the Chesapeake Bay, the Atlantic coastal bays and the Atlantic Ocean.  It encompasses 16 counties and Baltimore City, extends across two-thirds of the State, and is home to 70% of the State’s residents.  Additional information about Chesapeake & Coastal's programs, publications, and news can be found on the website, http://www.dnr.state.md.us/bay/czm.
